10 things to consider when making a claim

1. While we know it’s difficult, you need to stay in the Property for the duration of the claim and it can be a lengthy process. See our “Frequently Asked Questions” for more details.

2. Do you have proof of the notice given to your Landlord or can you get it?

3. If you have rent arrears, you need to bear in mind that these will be deducted from any compensation you receive from your Landlord before the balance is sent to us for you.

4. You need to remember that unfortunately not all repairs in your home may be classed as disrepair. See our “Frequently Asked Questions” for more details.

5. If you have completed repairs at your property yourself, your Landlord may now not be responsible to complete any further repairs to that part of the property or the item repaired, even if they normally would be.

6. If the disrepair in your home has damaged your belongings you may be able to claim for them. However, for your claim to be successful you need to be able to prove that the item was damaged by the disrepair, when you bought the item and what you paid for it.

7. If you can claim for your belongings, you may not recover the full purchase price for them as normal wear and tear and the age of the item would be taken into account.

8. Once we are instructed in respect of your claim, you can sit back, relax and leave everything to us. So if you need to raise any issues with your Landlord let us know and we will do it for you.

9. If any of the disrepair at your property is found to be your fault your Landlord can either refuse to do any necessary repair works OR they can do the works and then recharge them to you.

10. If you have suffered any injury or ill health as a result of the disrepair at your property you may be able to make a claim for it.

Things you cannot claim for

Any disrepair caused by any repairs or alternations that you have completed to the Property;
Any damaged belongings if you cannot prove the damage was caused by the disrepair or if you do not have proof of purchase for the belongings;
Any items that would generally be classed as your responsibility to repair, for example internal doors, overgrown gardens, general decoration, etc.
Any disrepair that is caused by how you live in or how you use the property;
Any damage you have caused to the Property.

What you should expect from your landlord

Your Landlord should attend your property to inspect the problems you have made them aware of within a reasonable period of time of first notice;
The Landlord should produce a Schedule of Works for any necessary repairs;
Your Landlord should then complete any necessary repairs that they are responsible for at your Property within a reasonable period of time from the date you first told them about the problem;
Your Landlord should give you reasonable notice of normally at least 24 hours (unless it is an emergency) before attending your Property to either complete an inspection or repair works;
Any notice given by your Landlord should normally be in writing;
Once we are instructed to deal with your claim all inspections and any repair works should be arranged via us;
Your Landlord should allow you the opportunity to get an independent expert surveyor to attend your property to complete an inspection if required before any works are completed;
Your Landlord should agree an appropriate Schedule of Works with us before any works are completed;
Your Landlord should make arrangements to move you into temporary accommodation while any works are completed at your property if appropriate and would be asked to cover your out of pocket expenses for doing this.
